1. Introduction
Welcome to Augustus Vacation Homes. These Terms of Use (“Terms”) govern your access to and use of the website augustus-homes.ae (the “Website”) and all related services, including short-term rental bookings and property management services (together, the “Services”) provided by Augustus Vacation Homes LLC (“Augustus”, “we”, “us”, “our”).
Augustus Vacation Homes LLC is a limited liability company registered in Dubai, United Arab Emirates, holding Dubai Economy and Tourism (DET) Trade License No. 1362939 and operating as a licensed Holiday Homes operator under the Department of Economy and Tourism of Dubai.
By accessing or using this Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Website or the Services.
2. Definitions
“Client” / “You” / “Your” means any person accessing the Website or using the Services, including guests, property owners, and visitors.
“Guest” means any person booking or occupying a property marketed or managed by Augustus.
“Owner” means any person entering into a property management agreement with Augustus.
“Property” means a short-term rental unit marketed, managed, or operated by Augustus.
“Booking” means a confirmed reservation to stay at a Property.
3. Services
Augustus provides two primary categories of Services:
3.1 Short-Term Rental Bookings. We market and let furnished residential units for short-term stays in Dubai, UAE, in compliance with Executive Council Resolution No. 41 of 2013 (as amended) and the Holiday Homes regulations issued by DET.
3.2 Property Management. We provide end-to-end short-term rental management services to Owners under a signed Property Management Agreement, which governs the commercial relationship between Augustus and the Owner.
Nothing on this Website constitutes a binding offer. All bookings and management engagements are subject to a separate written agreement and confirmation by Augustus.
4. Bookings and Payments
4.1 Direct Bookings. Direct bookings made through this Website are processed via our property management system (Hostaway) and payments are collected through Stripe. All payment data is handled directly by Stripe under its own terms and security standards.
4.2 Third-Party Platforms. Bookings may also be made through Booking.com, Airbnb, Expedia, and other online travel agencies. Where you book through a third-party platform, that platform’s terms, cancellation rules, and payment policies apply in addition to these Terms.
4.3 Pricing and Taxes. All prices displayed on the Website or quoted directly are in United Arab Emirates Dirhams (AED) unless stated otherwise. Prices are inclusive of 5% UAE Value Added Tax (VAT). A Tourism Dirham fee (currently AED 10–20 per bedroom per night, as set by DET) is added at check-in or included in the total, depending on the booking channel.
4.4 Security Deposit. A refundable security deposit may be required for direct bookings. The amount, hold method, and refund timeline will be disclosed at the time of booking.
5. Guest Obligations
By booking a Property, you agree to:
Provide valid passport or Emirates ID copies for all guests prior to check-in, as required by DET and Dubai Tourism regulations.
Complete online check-in registration before arrival.
Observe the house rules and building regulations of the Property.
Not host parties, events, or exceed the registered guest count.
Comply with UAE law, including laws relating to public conduct, drugs, alcohol, and privacy.
Reimburse Augustus for any damage caused during your stay, beyond normal wear and tear.
Failure to complete DTCM-mandated registration may result in denied access to the Property with no refund.
6. Cancellations and Refunds
Cancellation terms are determined by the booking channel. For direct bookings, the specific cancellation policy applicable to your reservation is displayed at the time of booking and is incorporated into these Terms by reference. For third-party bookings, the cancellation policy of the respective platform applies.
Non-refundable bookings are not eligible for refund except where required by applicable UAE law.
7. Property Owner Services
Property management services are governed by a separate Property Management Agreement signed between the Owner and Augustus. The Website provides general information only and does not constitute an offer or binding commitment to onboard any specific property.
8. Intellectual Property
Unless otherwise stated, Augustus and its licensors own all intellectual property rights in the Website, including all text, images, photography, graphics, logos, trademarks, trade names, and software.
You may access and view content on the Website for personal, non-commercial use only. You must not:
Republish, reproduce, duplicate, or copy material from the Website.
Sell, rent, sublicense, or redistribute content from the Website.
Use any photographs, videos, or marketing material from the Website or associated OTA listings on any other platform without our prior written consent.
All property photography, including interior and exterior images, is the exclusive property of Augustus Vacation Homes LLC or its licensors. Unauthorized use will be enforced under UAE Federal Law No. 38 of 2021 Concerning Copyright and Neighboring Rights.
9. Copyright Complaints
If you believe content on the Website infringes your copyright, send a written notice to legal@augustus-homes.ae including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement that you have a good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
10. User Content
Where the Website allows you to post comments, reviews, or other content, you grant Augustus a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and display that content.
You warrant that your content: (a) does not infringe any third-party intellectual property rights; (b) is not defamatory, offensive, or unlawful; (c) does not violate any person’s privacy; and (d) is not used to promote unrelated commercial activity.
Augustus reserves the right to remove any content at its sole discretion.
11. Hyperlinks and Framing
You may not frame, mirror, or create a browser or border environment around the Website without our prior written consent. Hyperlinks to the Website are permitted provided they are not deceptive, do not falsely imply sponsorship or endorsement, and do not display Augustus content in a misleading or damaging context.
12. Third-Party Links
The Website may contain links to third-party websites. Augustus has no control over the content, privacy practices, or availability of those websites and accepts no responsibility for them.
13. Internal Accounting and Operations Integrations
Augustus Vacation Homes LLC operates internal applications and AI-assisted agents that connect to the company’s own systems — including QuickBooks Online, Hostaway, Stripe, Gmail, and Google Drive — to automate bookkeeping, reconcile payments, parse operational documents, and prepare financial reports.
Purpose. These integrations are used solely to support internal accounting, reconciliation, VAT reporting, and operational workflows of the company.
Users. The integrations are used exclusively by Augustus Vacation Homes LLC and its authorized staff. They are not offered, sold, or made available to any third party.
Write-back controls. Automated agents read data by default. Any modification to accounting records, outgoing communications, or external systems is executed only after confirmation by an authorized staff member.
Connection and disconnection. Each integration can be revoked at any time from the respective source system (for example, QuickBooks Online: Settings → Apps → Connected apps). Upon revocation, the application loses access to that system’s data.
Limitation of liability. These integrations are internal operational tools and are provided “as is”. All bookkeeping, tax, and business decisions remain the responsibility of the company, its accountants, and its auditors.
14. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable UAE law:
The Website and Services are provided “as is” and “as available”, without warranty of any kind, express or implied.
We do not warrant that the Website will be uninterrupted, error-free, or that content is accurate, complete, or current.
Augustus will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the Website or Services.
Our total liability to you in connection with any booking shall not exceed the amount paid by you for that specific booking.
Nothing in these Terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under applicable UAE law.
15. Force Majeure
Augustus is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, pandemics, platform outages, or regulatory changes affecting short-term rental operations.
16. Changes to These Terms
We may update these Terms at any time. The updated version will be posted on this page with a new “Last updated” date. Continued use of the Website after changes are posted constitutes acceptance.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Dubai Courts.
